OFFICIAL RULES

The Grassroots Fundraising Contest (“Promotion”) is sponsored by The Youth Cafe, P.O. Box 4261 00100, Nairobi, Kenya (“Sponsor”). PROMOTION IS VOID WHERE PROHIBITED. Failure to comply with these rules may result in disqualification. PLEASE READ THESE OFFICIAL RULES BEFORE ENTERING THE PROMOTION. BY PARTICIPATING IN THE PROMOTION, YOU AGREE TO BE BOUND BY THESE OFFICIAL RULES AND REPRESENT THAT YOU SATISFY ALL OF THE ELIGIBILITY REQUIREMENTS BELOW.

1. Eligibility. PROMOTION VOID WHERE PROHIBITED. PROMOTION OPEN ONLY TO INDIVIDUALS OVER THE AGE OF 18 (OR THE AGE OF MAJORITY UNDER APPLICABLE LAW) WHO WOULD BE LAWFULLY PERMITTED TO ACCEPT THE PRIZE, UNDER APPLICABLE LAWS AND REGULATIONS, INCLUDING ETHICS LAWS. IF YOU DO NOT MEET THESE REQUIREMENTS YOU ARE NOT ELIGIBLE TO WIN A PRIZE, AND SPONSOR RESERVES THE RIGHT NOT TO AWARD PRIZES TO YOU. All applicable federal, state and local laws and regulations apply.

2. Taxes and Prize Terms. ALL FEDERAL, STATE, AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE THE SOLE RESPONSIBILITY OF WINNER. All prizes will be awarded. The prize may be forfeited and awarded to an alternate eligible winner if two attempts to contact the winner by phone and/or e-mail are not successful. Prizes are not transferable. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any prize. Limit one prize per household or address. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).

3. Disclaimer. Sponsor and any of its parent companies, subsidiaries, affiliates, directors, officers, professional advisors, and employees (collectively, the "Released Parties") will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any Promotion disruptions, injuries, losses or damages caused by events beyond the control of Sponsor or by non-authorized human intervention; or (d) any printing or typographical errors in any materials associated with the Promotion.

4. Promotion Period. The Promotion starts September 12, 2020 and ends on October 25, 2021 at 11:59pm EDT (the "Promotion Period"). All entries must be received during the Promotion Period to be eligible to win a prize.

5. Contest rules. An individual may create only one fundraising page for and on their own behalf; fundraising pages associated with multiple individuals, teams or groups are not eligible to win. Winners will be selected solely based on the following objective criteria: 1) largest amount of dollars raised through personalized fundraising page and 2) largest number of donors recruited through personalized fundraising page. All winners will be contacted by email or phone. To claim the prize, each potential winner should follow the instructions contained in their notification.

In the event of a tie for most dollars raised, the winner will be chosen based on the highest number of donors and in the event of a tie for most donors, the winner will be chosen based on the highest amount of dollars raised. In the event of a tie for both dollars raised and most donors for either prize, all participants will be rewarded with the prize.

6. Prizes. Winners will receive the following prizes:

a) For September (September 12, 2020 - September 30, 2021 at 11:59 p.m. EDT):

i) Participant who secures the highest number of individual donors will win a t-shirt from the Biden for Victory Fund, retail value $30.

ii) Participant who raises the most money will win a swag bag with various merchandise items, retail value of $100.

September winners will be selected based on numbers on 9/30/2021 at 11:59 p.m. EDT.

September winners will be notified by email or phone on or after October 1, 2021.

b) For October (October 1, 2020 - October 25, 2020 at 11:59 p.m. EDT):

i) Participant who secures the highest number of individual donors will win a t-shirt from the Biden for Victory Fund, retail value $30.

ii) Participant who raises the most money will win a swag bag with various merchandise items, retail value of up to $100.

October winners will be selected based on numbers on 10/25/2020 at 11:59 p.m. EDT.

October winners will be notified by email or phone on or after October 26, 2020.

c) For the full contest period (September 12, 2020 - October 25, 2020 at 11:59 p.m. EDT):

i) Throughout the contest period, each Friday at 11:59 p.m. EDT, Participant who raised the most money over the previous 7 days (since the previous Saturday at 12:00 a.m. EDT) will win a promo code for 10% off to the Biden Victory Fund Store, along with a sticker and button, retail value $10. In the event of a tie for most dollars raised each week, the winner will be chosen based on the highest number of donors from that week.

ii) Grand prizes: Participant who raises the most money through their grassroots fundraising page (over the full contest period from September 12, 2020 - October 25, 2020) and participant who gathers the most individual donors over the full contest period will each win the grand prize of the opportunity for a 30-minute virtual game night, happy hour, or conversation with celebrity of their choice from a list provided by the campaign and a t-shirt from the Biden for Victory Fund, retail value $30. Grand prize winners will be chosen on 10/25/2020 at 11:59 p.m. EDT and will be notified by email or phone on 10/26/2020; Winners must provide their selection by 10/26/2020 at 11:59 p.m. EDT. Each person is only eligible to win one (1) grand prize. If an individual is in first place for both categories, the grand prize for most dollars raised will be awarded to the second place winner for that category. Both grand prize events will take place on October 29, 2020 from 8-8:30pm EDT. The date and time of the event cannot be changed. Both grand prize winners will choose from the same list of options. In the event that both winners choose the same individual the winner that responded second will need to choose someone else from the provided list.

7. How to Enter. Participants may enter the contest as follows: by creating your own personalized fundraising page. Instructions on setting up a personalized, individual fundraising page are here: The Youth Cafe grassroots fundraising-team. Contribution Conditions: For individuals who choose to donate, we are asking for a donation of any amount up to $2,800 from individuals to Biden for President. Biden for President does not accept contributions from corporations or their PACs, unions, federal government contractors, national banks, those registered as federal lobbyists or under the Foreign Agents Registration Act, or foreign nationals. Failure to submit all required information in the manner required in these Official Rules and/or any entry form may result in disqualification. All entrants and entries are subject to verification by Sponsor. Entries will not be acknowledged or returned. Each person may only enter the contest once by creating one (1) personalized, individual fundraising page. Multiple entries are prohibited. Automated entries are prohibited. By entering the Promotion, you consent to 1) your first name and last initial being shared on the Sponsor’s website, and 2) being placed on an e-mail mailing list to receive information from Sponsor and for other purposes in accordance with Sponsor’s Privacy Policy.

8. Winner Name; Rules Request. For the winner’s name, send a stamped, self-addressed, business-size envelope after 10/31/2020 and before 11/01/2020 to Sponsor at the address listed above, Attn: “Grassroots Fundraising Contest.” Alternatively, this request may be made by email by sending an email to info@theyouthcafe.com. To obtain a copy of these Official Rules, send a stamped, self-addressed business-size envelope to Sponsor at the address listed above, Attn: “Grassroots Fundraising Contest Promotion’ Rules Request” or by sending an email to info@theyouthcafe.com. Residents of Vermont may omit return postage.

9. General Release. By entering the Promotion, you release Sponsor and all Released Parties from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Promotion or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.

10. Miscellaneous. The Promotion and these Official Rules will be governed, construed and interpreted under the laws of Kenya without regard to its or any other jurisdiction's choice of law provisions. Entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all respects. Any provision of these Official Rules deemed unenforceable will be enforced to the extent permissible, and the remainder of these Official Rules will remain in effect. Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend or cancel the Promotion or any entrant's participation in the Promotion should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor's control affect the administration, security or proper play of the Promotion, or Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Promotion as planned. Entrants who violate these Official Rules, violate any law, rule or regulation in connection with participation in the Promotion, tamper with the operation of the Promotion or engage in any conduct that is detrimental or unfair to Sponsor, the Promotion or any other entrant (in each case as determined in Sponsor's sole discretion) are subject to disqualification from entry into the Promotion. Sponsor reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Promotion.
